Public Offer Agreement
on Charitable Donation (Aid)
The text of this Agreement set forth below is addressed to individuals and/or legal entities and constitutes an official public offer (in accordance with Article 641 of the Civil Code of Ukraine) of the CHARITABLE FUND “BLAGOMAY”, represented by Acting Chairperson of the Management Board Kira Syrotenko, acting on the basis of the Charter (hereinafter referred to as the “Fund”), to conclude an agreement on charitable donation (aid) under the terms and conditions specified below.
A public offer (offer) shall mean the opportunity, primarily for individuals, to voluntarily and willingly provide charitable aid (donation) through the Fund.
1. Subject of the Agreement
Charitable aid (donation) shall mean the gratuitous transfer by a person (Donor) of funds into the ownership of the Fund for their further use to achieve the goals of the Fund as defined by the Charter or the Fund’s programs, in accordance with the Law of Ukraine “On Charitable Activities and Charitable Organizations”, the Charter of the Fund, and the terms of this Offer.
Acceptance of the Offer (i.e., acceptance of the Offer by performing actions, including the transfer of funds) confirms that the person making the donation (Donor) agrees with all the terms of the Offer, understands and accepts them.
In particular, a Donor who makes a donation for a specific project (targeted donation) agrees to the redistribution/use of such funds for other projects (for example, if the fundraising campaign has been completed or is no longer relevant).
The Donor (payer) agrees that the amount of charitable aid (donation) is non-refundable.
The subject matter of this Agreement does not involve direct or indirect profit-making.

2. Rights and Obligations of the Donor
The Donor undertakes to:
- familiarize themselves with the Charter of the Charitable Organization;
- comply with the requirements of this Agreement.
The Donor has the right to:
- monitor the use of charitable aid (donation) by the Fund for its intended purpose;
- review reports on the provision of charitable aid published on the website and official pages of the Fund.
3. Rights and Obligations of the Fund
The Fund undertakes to:
- use the charitable aid received from the Donor in accordance with its intended purpose and in compliance with the Charter, the terms of this Offer, and the current legislation of Ukraine;
- provide the Donor, upon request, with a report regarding the donation in the manner, within the terms, and in the form approved by the Fund based on the requirements of the current legislation of Ukraine;
- provide, upon the Donor’s request, any statutory documents of the Charitable Organization.
The Fund has the right to use part of the charitable aid for administrative expenses of the Fund in an amount not exceeding that provided for by the Law of Ukraine “On Charitable Activities and Charitable Organizations”.
4. Guarantees Regarding Charitable Aid
The Fund undertakes not to allow the use of donations for purposes other than those defined by this Offer, the statutory activities, and programs of the Fund.
Performance of this Offer is not intended for direct or indirect profit-making.
In the case of a targeted donation for a specific program or project, if such program or project is not implemented, the donation (aid) shall be redistributed to another project or other types of statutory activities of the Fund.
5. Term of Charitable Aid Provision
Receipt of charitable aid (donations), namely funds transferred into the ownership of the Fund for further use and achievement of the goals defined by the Charter or the Fund’s programs, shall continue until the termination of the Fund’s activities unless otherwise determined by decisions of its governing bodies.

From the moment of acceptance of the Offer, this Agreement shall be deemed concluded in written form in accordance with Articles 207, 639, 641, and 642 of the Civil Code of Ukraine and Articles 6 and 7 of the Law of Ukraine “On Charitable Activities and Charitable Organizations”.

to the Public Offer Agreement
on Charitable Donation (Aid)
Consent Notice
on Collection, Processing, and Use of Personal Data
The Donor, being the person who accepted this Offer, voluntarily and without coercion confirms that, in accordance with the provisions of the Law of Ukraine “On Personal Data Protection”, they grant consent to the other Party (the Fund) for the processing of their personal data for the purpose of ensuring the implementation of economic relations, tax relations, and accounting activities.
The person also confirms that they have been informed about the inclusion of their personal data into the Fund’s personal data database, that the actual scope of transferred data corresponds to the purposes of processing, and that they are informed about the rights of the personal data subject as defined by Article 8 of the Law of Ukraine “On Personal Data Protection”.
The Party to the Agreement that has received personal data of the representative of the other Party undertakes to ensure protection of such data against unlawful processing and unlawful access in accordance with the requirements of Article 24 of the Law of Ukraine “On Personal Data Protection” and other requirements established by the current legislation of Ukraine.
This consent notice shall remain valid for an indefinite period.
